DAYTON CHRISTIAN SCHOOLS
In the November issue of the Banner of Truth, the U.S. Federal Court decision upholding religious freedom in the Dayton Christian Schools case was reviewed. Dayton Christian Schools maintains a teacher hiring policy, based on the Bible, that mothers with pre-school age children ought to be home with their children and will not be hired on a full-time basis by the schools.
The State of Ohio appealed the case and the U.S. Supreme Court agreed on 12 November 1985 to hear the case. The hearing will most likely take place in the spring 1986.
The Dayton case, as well as a nearly identical case involving one of our denominational schools, involves a conflict of two fundamental rights embodied in the U.S. Constitution and Federal law. These two rights are the right to freely exercise one’s religion according to the dictates of Bible and conscience and the right to be treated with equality, i.e., freedom from discrimination. In the Dayton case, as well as the case involving one of our denominational schools, the plaintiff is charging sexual discrimination and is seeking, among other things, to have the Court bar the school from practicing its religious beliefs. Since the issue has never come to the Supreme Court before, the Dayton case promises to result in a landmark decision with profound effects for the future.
The upcoming case is reason for earnest prayer that God will incline the hearts of the Supreme Court Justices to uphold religious freedom. Pray that they may place religious freedom above man’s goal of sexual equality. Much is at stake but God still reigns and the hearts of all men are in His hand. Also remember Dayton Christian Schools. They have already been through three levels of appeals and have accumulated significant costs in defending a cause that has profound impact on religious schools all across the United States. Pray that they may maintain God-centered courage and commitment to Bibical principles to carry them through the upcoming test. Financial and legal pressures combined with the feeling of standing alone can be overwhelming. BURIAL OF 16,433 ABORTED FETUSES
The remains of 16,433 aborted fetuses received an interdenominational burial service in Los Angeles October 6. The fetuses, found in a storage container three-and-a-half years ago, have been the focus of a lengthy court battle.
The fetuses were discovered in 1982 in plastic bags covered with formaldehyde outside the home of a former medical laboratory director. After a three-year court battle by the Southern California chapter of the Catholic League, Los Angeles County’s decision to incinerate the fetuses without religious rites was reversed.
The county had refused to conduct a funeral, saying it would violate the separation of church and state.
A Superior Court judge in July ruled the county had the right to authorize the burial of the aborted fetuses as long as it did not encourage or discourage a religious service. The Feminist Women’s Health Center of Los Angeles tried in late September to block the funeral plans, arguing that the burial would violate the privacy of women who had undergone the abortions.
TAX EXEMPTION DENIED TO WITCHCRAFT GROUPS
Organizations that practice witchcraft or satanism will not be tax-exempt if Congress approves a measure passed by the U.S. Senate. The action was proposed by Sen. Jesse Helms (R-N.C.) as an amendment to the Treasury, Postal Service and General Appropriations Act of 1986. It stipulates that no tax exemption will be permitted for any “cult, organization or other group that has a purpose, or that has any interest in, the promoting of satanism or witchcraft.”
